Terms of Use

March Drum Corps, Inc., referred to as “MDC,” “we,” “us,” or “our,” is a Virginia non-stock corporation recognized as a public charity under Section 501(c)(3) of the Internal Revenue Code.

MDC provides an online platform connecting students with a network of music instructors. These Terms of Use govern your access to and use of the March Drum Corps platform and related services.

1. Acceptance of Terms of Use Agreement

These Terms of Use constitute an electronic agreement between you and March Drum Corps, Inc. governing your use of the March Drum Corps platform and related services.

By creating an account, accessing the platform, booking a lesson, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.

Our policies and further terms applicable to particular Services may be incorporated into these Terms by reference. We may modify these Terms as permitted by this Agreement and applicable law.

Nonprofit Status

MARCH DRUM CORPS, INC. is a Virginia non-stock corporation recognized as a public charity under Section 501(c)(3) of the Internal Revenue Code.

2. Eligibility and Parental Consent

Use of our Services is void where prohibited by law.

Account creation and booking require users to be at least 18 years of age.

Students under 18 years of age (“Minors”) may use the Services only through or with the explicit, verified consent of a parent or legal guardian.

Parental Presence Requirement

A parent or legal guardian must be present or in the immediate physical vicinity and accessible during all online, one-on-one instructional sessions involving a Minor Student.

3. How the Service Works

MarchDrumCorps.org is an online platform for connecting Students and Instructors of music and marching arts instruction.

MDC facilitates instructor discovery, scheduling, video connectivity, communication, and payment processing.

MDC does not guarantee any particular instructional outcome, performance result, competitive result, audition result, or other result from an Instructor’s services.

4. Membership and Accounts

4.1 Student Membership

As a Student Member, you may book and pay for lessons, manage schedules, communicate with Instructors, and use other available platform services.

Student Members agree to receive transactional and reminder text/SMS and email messages relating to booked lessons and other necessary account or transaction activity.

4.2 Instructor Membership

Instructors must be at least 18 years old.

Acceptance, listing, suspension, or removal of an Instructor listing is at MDC’s discretion, subject to any separate agreement between MDC and the Instructor.

Instructors are responsible for maintaining accurate qualifications, pricing, availability, and other profile information and for complying with applicable legal, safety, and background-screening requirements.

4.3 General Disclaimer and Code of Conduct

MDC does not guarantee the complete accuracy of user-generated content, instructor-provided information, or other information submitted by users.

Users agree not to:

• Engage in unlawful conduct through or in connection with the Services;
• Harass, threaten, intimidate, or abuse other users;
• Spam or send unsolicited communications through the platform;
• Share accounts or account credentials with another person;
• Attempt to circumvent platform fees or other platform requirements;
• Interfere with the operation, security, or integrity of the Services; or
• Use the Services for purposes that violate these Terms or applicable law.

5. Pricing, Cancellations, Refunds, Credits, and Technical Issues

5.1 Pricing

Lesson prices are established at the time of booking and honored for confirmed sessions, subject to the applicable cancellation, refund, credit, and technical-issue provisions of these Terms.

5.2 Student Cancellations

• 48 Hours or More Before Lesson: The Student receives the full lesson value as MDC lesson credit, or may request a cash refund to the original payment method, less actual nonrefundable payment-processing fees.
• Less Than 48 Hours Before Lesson: The Student forfeits a flat $10 cancellation fee. The remaining lesson value becomes MDC lesson credit or may be refunded to the original payment method upon request, less applicable processing fees.

5.3 Student No-Shows

If a Student fails to attend a scheduled lesson within 15 minutes of the scheduled start time, the session is forfeited without refund.

5.4 Instructor Cancellations and No-Shows

If an Instructor cancels or fails to attend a scheduled lesson, the Student receives full lesson credit or may request a cash refund to the original payment method.

Instructor compensation and any consequences applicable to an Instructor cancellation or no-show are governed by applicable MDC instructor policies.

5.5 Technical Interruptions and Outages

• Early Disconnect — First 10 Minutes: If a lesson cannot proceed because of platform downtime, an internet disconnect, or video technology failure within the first 10 minutes, the session shall be rescheduled at no cost. If rescheduling is impossible, a full credit or refund is issued.
• Substantial Completion — Past 50% of Duration: If a technical failure occurs after more than 50% of the scheduled duration has elapsed and the lesson cannot be restored, the lesson is deemed completed and no cash refund is issued.

5.6 Lesson Credits and Expiration

Lesson credits expire six (6) months from the date of issuance unless otherwise specified at the time the credit is issued.

Expired lesson credits cannot be renewed or refunded.

6. Term and Account Termination

These Terms remain in effect while you access or use the Services.

You may terminate your account at any time by following the applicable account-termination procedures or by contacting MDC.

MDC may suspend or terminate an account or restrict access to the Services when permitted by these Terms, applicable policies, or law, including where MDC reasonably believes that a user has violated these Terms, engaged in unlawful conduct, created a safety risk, or otherwise misused the Services.

Termination does not eliminate obligations that by their nature should survive termination, including obligations concerning outstanding payments, intellectual property, confidentiality, dispute resolution, and non-circumvention.

7. Non-Circumvention and Direct Transactions

During membership and for two (2) years following the last transaction through MDC, Members shall not knowingly solicit, arrange, or complete direct paid instruction with Members introduced through MDC for the purpose of avoiding MDC platform fees.

This provision is intended to protect the platform and the resources MDC uses to connect Students and Instructors.

8. Dispute Resolution and Governing Law

These Terms and any dispute arising from or relating to your use of the MDC platform are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Disputes between MDC and a platform user arising from or relating to the use of the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, except where applicable law provides otherwise.

Arbitration shall be conducted on an individual basis. To the extent permitted by applicable law, the parties waive the right to participate in a class action, class arbitration, collective action, or representative proceeding concerning a dispute covered by this arbitration provision.

Nothing in this section prevents a party from seeking relief that cannot lawfully be required to proceed through arbitration or from pursuing other rights that applicable law expressly preserves.

9. Modifications to These Terms

MDC may modify these Terms of Use from time to time as permitted by applicable law.

When material changes are made, MDC may provide notice through the platform, by email, or by other reasonable means.

The updated Terms will become effective on the date specified in the updated Terms. Continued use of the Services after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.

10. General Provisions

10.1 Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

10.2 Entire Agreement

These Terms constitute the agreement between you and MDC concerning your use of the Services, except where a separate written agreement expressly governs a separate relationship or transaction.

10.3 No Waiver

MDC’s failure to enforce any provision of these Terms does not constitute a waiver of MDC’s right to enforce that provision later.

10.4 Electronic Agreement

You agree that electronic acceptance of these Terms, including acceptance through an account-creation checkbox, constitutes your electronic signature and agreement to these Terms to the extent permitted by applicable law.
